Affordable Care Act - Essay Example This memo will investigate the impact of ACA on Employer-Sponsored Insurance (ESI) and will specifically examine various aspects of the Act that can discourage large employers’ to offer healthcare coverage to their employees. This can ultimately result in reduced access and quality of the healthcare services and increased costs. ACA is a law of primary importance for the people of United States because it aims to address many long standing issues with our health insurance policies including the coverage of children on parental policy, cessation of ‘donut hole’ for seniors, elimination of lifetime dollar limit on coverage, free preventive care and many other provisions with an aim to cover every segment of the society to maximum possible limit of coverage, even the uninsured people with a program to extend access to insurance and more funds to states to help them in extending Medicare facilities to low-income seniors. In essence, the program is a tremendous effort to fill the gaps of insurance coverage while safeguarding the rights of stakeholders. Still, there are areas which required attention of the legislators to device some amendments in the program in order to ensure and extend its impact on access, cost and quality of health care services. The employer sponsored insurance coverage is the hottest among the controversial issues associated with provisions of ACA that are supposed to be in effect by 2014. There are two major aspects of the ACA provisions, firstly the impact of Tax Credits to small businesses and its impact on coverage offers by the employer to low and medium salaried employees and secondly the impact on large employers after 2014 when the law will be in effect with all its provisions. The employer-sponsored insurance (ESI) is of immense importance to the American people because larger employers plays an important role in overall health insurance coverage and if these firms decided to drop the coverage its impact will certa inly deplore the positivity of the ACA. However, there is a clear divide among the experts and analyst over the estimates of large firms’ response in 2014. Some forecast a big drop in ESI and other estimate it to be stable. â€Å" While the overall ESI market is likely to remain fairly stable, modelers and other experts agree that some firm types and covered subgroups are likely to experience changes in coverage soon after 2014.† (Avalere, 2011). Although most of the surveys and analysis project a stable ESI market in post-2014 scenario, there are experts, firms and analyst who oppose with some valuable reasoning and proclaim that ACA provisions can cause a major shift in employers’ policy of health insurance offerings. â€Å"Overall, 30 percent of employers will definitely or probably stop offering ESI in the years after 2014.† (Singhal, Jeris, & Drew, 2011). Growth needs to be encouraged in every way possible.   I’m now working in Health and Social Care, it’s my first job here in the UK.I find that here in Great Britain has loads of legislation designed to ensure that discrimination on certain grounds is unlawful, and also protect workers like me. This report will cover pieces of aspects of employment covered by legislation relevant to this area, outlining why legislation relating to employment exists and the list of sources of information and advice about employment responsibilities and rights: The Equality Act 2010 The Equality Act 2010 consolidates the previous nine pieces of equality legislation based on protected characteristics to create, for the first time in Great Britain, unified equality legislation. The nine protected characteristics are: age, disability, gender reassignment, marriage and civil partnership, pregnancy and maternity, race, religion or belief, sex and sexual orientation. Among other things, the Act simplifies or clarifies the definitions of direct discrimination (including association and perception), indirect discrimination, harassment and victimisation and extends positive equality duties to public authorities which must have due regard to the need to eliminate discrimination, advance equality of opportunity, and foster good relations between different groups. The definition of disability under the law has changed such that a person who ahs a â€Å"physical or mental impairment that has long-term adverse effect on their ability don’t have to show that their impairment affects a particular capacity. The definition of gender reassignment has also been change-stating that this apply to â€Å" a person who is proposing to undergo, is undergoing or has under gone process to change their sex†. Sex Discrimination Act 1975 The Sexual Discrimination Act of 1975 was introduced to protect individuals from discrimination on the grounds of gender. Sexual Discrimination can take many forms. It is essential to understand that sexual discrimination is judged to be unwanted attention by the victim of the behaviour, not the perpetrator. Discrimination was set out in two forms: Direct Discrimination- simply stated that one person is treated less favourably than another based on gender. Indirect Discrimination –on the other is quit complex, this takes place if a requirement or condition is imposed, which has nothing to with gender but in practices. The Sex Discrimination Act also made it unlawful; to discriminate on the ground of marital status. Equal Pay Act 1970/1975 It simply states that Men and Women should receive equal pay for work of equal value. Human Rights Act 1998 The Human Right Act 1998 was introduced by Parliament and came into force in October 200. There are different article in this Act. Theses include: Article 2- everyone’s right to life shall be protected by law. Article 3- no one shall be subjected to degrading treatment. Article 5- everyone has the right to liberty and security of a person. Article 8-eeryone has the right to respect for his private and family life and his correspondence. Article 9- everyone has the right to freedom of thought, conscience and religion. Article 12- men and women of marriageable age have the right to marry and found a family. Article 14- the enjoyment of these rights and freedoms set forth in this Convention shall be secured without discrimination on any ground. Police and Criminal Evidence Act 1984 Establishes the rights of all people arrested by the police. Detainees have the right to legal advice and right to notify person who is likely interested in their welfaire. Civil Partnership Act 2004 This establishes the right of same sex couples to enter into a civil partnership. This is not marriage but is a relationship of equivalent seriousness and commitment. Health and Safety Health and safety is important to every work that we do. The legislation of health and safety is generally covered by statutory regulations. These legislations are: Health and Safety at Work Act 19 74 Employers have a duty to ensure the health and safety at work for all employees, provide and maintain equipment and system in safe condition and provide information, training and supervision relating to health and safety at work. Managers have the duty to maintain a safe working environment for all staff, ensuring that staffs follow policies, procedures and instructions. Give well information about hazard and safe working to new members of staff and also to report or record any accidents. Employees have duty to follow rules and regulation at work, ensure that they use materials in recommended procedures and not misuses anything provided for health ,safety and welfare. Food Safety Act 1990 This applies wherever food is supplied other than within a family situation. This Act is a wide ranging piece of legislation which strengthened and updated existing laws relevant to food and safety. Holidays Annual leave entitlements should be agreed when an employee starts work, details of holidays and holiday pay should be found in the employees written statement or contract of employment. Most workers are legally entitled to 5.6 weeks paid holiday per year (this is known as statutory entitlement). Part time worker are entitled to the same amount of holiday (pro rota) as full time colleagues. Employers can set the times when workers can take their leave for example a Christmas shut down. If employment ends workers have the right to be paid for any leave due but not taken. There is no legal right to paid public holidays Equal pay Employers must give men and women equal treatment in the terms and conditions of their employment contract if they are employed to do: like work work that is the same or broadly similar  work rated as equivalent under a job evaluation study Work found to be of equal value in terms of effort, skill or decision making. Employees are also entitled to know how their pay is made up. For example, if there is a bonus system, everyone should know how to earn bonuses and how they are calculated. National Minimum Wage Most workers in the UK over school leaving age are entitled to be paid at least the NMW. The NMW rates are reviewed each year by the Low Pay commission. Most workers will be entitled to the National Minimum Wage (NMW). Normally the NMW rate changes in October each year. There are no exemptions according to the size of business. HM Revenue Customs can take employers to court for not paying the NMW. II. Outlining why legislation relating to employment exist: Legislation relating to employment exists to stop exploitation of workers by their employers mainly to protect the rights of their employee’s and to make sure that they have everything they need such as: * Minimum wage * Safety standards * Holiday entitlement * Maternity leave * Redundancy payments * Discrimination laws * Maximum working hours * Age requirement All employees need to have all good things that protect them from unscrupulous bosses. III. Sources of information and advice about employment and rights: * Contract- All employees have an employment contract with their employer. A contract is an agreement that sets out an employee’s: employment conditions rights responsibilities duties These are called the ‘terms’ of the contract. * Handbook- An employee handbook, sometimes also known as an employee manual or staff handbook, is a book given to employees by an employer. Usually, the employee handbook contains information about company policies and procedures. * Policy documents is a deliberate system of principles to guide decisions and achieve rational outcomes. A policy is a statement of intent, and is implemented as a procedure or protocol. Policies are generally adopted by the Board of or senior governance body within an organization whereas procedures or protocols would be developed and adopted by senior executive officers. * Terms and conditions -Terms and conditions of employment are the elements of a contract which help to define the relation between an employer  and an employee * Job description A broad, general, and written statement of a specific job, based on the findings of a job analysis. It generally includes duties, purpose, responsibilities, scope, and working conditions of a job along with the jobs title, and the name or designation of the person to whom the employee reports. Job description usually forms the basis of job specification.

The Conflict in the Balkans The conflict in the Balkans is interesting because for years, reporters and politicians have touted it as being the result of ancient ethnic hatred. The first phase of Yugoslavian disintegration can be attributed to the conditions of the people living in Kosovo, an autonomous province of Yugoslavia. In 1981, the socioeconomic conditions in Kosovo were far worse than those in the other republics of Yugoslavia. Poverty was rampant and unemployment was around twenty percent as compared to about two percent in Slovenia that same year. The standard of living in Kosovo was deplorable and whatever aid was given to the province by the federal government was mismanaged. Another significant problem with this particular province was that while the Serbs claimed the province as the â€Å"Cradle of Serbian Empire† because of a legendary battle and defeat that happened at Kosovo in 1389. The Albanians constituted approximately eighty percent of the population of Kosovo. In reality, Kosovo c ould be claimed more by the Albanian majority than by the Serb minority. Many of the valiant warriors who fought and died at the Battle of Kosovo were in fact Albanian warriors, a fact seldom acknowledged by the Serb leadership. The â€Å"Serb Empire† was not as grand and powerful as modern Serbia would contend. Relations between Albanians and Serbs were good in the Middle Ages. Under independent rule, the region was able to make available an Albanian curriculum and Albanian culture grew in importance. Economically, however, Kosovo was still suffering since whatever gains the economy made were outdone by the gains in population made by the Albanian Muslims. The power in Kosovo was vested in a small group of elite Albanians who did well at advancing national identity and improving education and other public works but who were poor at managing and maintaining a functional economy. Whenever federal funds were given to the province, those elites at the top either wasted the money on grandiose projects and ornate buildings or on their new and privileged lifestyles. In the late 1980’s, Slobodan Milosevic came to power in Serbia. His first actions were directed against Kosovo Albanian dominance in the province. He removed virtually all of the Albanian’s rights, their leadership role in government, their party, and their parliament. He further removed their control of ... ...t this help, something could be done against the police and army. The citizens could be taught to take a stand and protect themselves in a non-violent way. Having the knowledge that how you are living is not wrong and that the action by higher authority is not right, can make strength grow. The bottom line is that something needs to be done about the way citizens are treated in Albania. Maybe it isn’t the place for the USA to step in, but on the other hand we could help them. In the near future things need to change over there but it is going to be a feat to get through to them. Nothing is ever a guarantee but every try is worth it to the citizens. A Terrible Thunder: The Story of the New Orleans Sniper Essay

On New Year’s Eve, in the city of New Orleans, in the year 1972, a sniper was hidden in the shadows. He is alone, with anger and hate fueling his tiny body he went on for many days to try to kill as many police officers as he could. The drama ended one week later when hundreds of police armed to the teeth and with the aid of a Marine Corps assault chopper descended on a burning building to battle with the lone sniper.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   This paper will look into the cause of such a violent outburst, of the senseless killing of innocent lives. And how it has gone out of control for the one of the victims in that infamous day of shooting was a black man just like the shooter somewhere above, in a building, hidden from view. Colored Puberty is the age where many young boys find themselves in a suspended animation in trying to discover their identity. To some it is a crisis stage and to many it is a turning point in their lives. In some cases though teenagers going through this phase are well adjusted and have a pleasant experience during this transition from childhood to adulthood. Most probably they live in a good home where their parents where able to shelter them from the evil world outside. But when it is time to go to college or when it is time to move out of the home to find employment, it is this period when the young man and woman gets the surprise of their lives. Mark James Essex had a similar experience when he left the protective confines of his hometown in Kansas. He joined the U.S. Navy in what is perhaps his ticket out of obscurity and poverty. He was able to accomplish one his objectives for in a way he became famous. But not for being rich and doing something worth emulating – he went down the annals of criminal history in one of the bloodiest day of gun related violence. All of these had its beginning when he went left home and an ominous sign of what is coming can be seen in one of his letters where he described his disappointment over what he had witnessed in the workplace and with deep sadness he wrote that the Navy, â€Å"†¦is not like I thought it would be, not like in Emporia. Blacks have trouble getting along here† (p. 15). His sadness was compounded by the resignation expressed by other fellow black enlisted personnel, who said that, â€Å"†¦it is just the way it is† (p. 15). When he went to his supervisor to complain about the racial slur and the discrimination that is going on like a plague on the base what he got was a gentle but confusing advice which is in essence to ignore the problem and channel his energies to do something really important – like finishing college through a Navy scholarship perhaps – and therefore increase his status. This kind of remarks confirmed in his mind that â€Å"†¦blacks were second-class citizens in the Navy, and it was hard for him to understand why no one seemed wiling to change things† (p.15). Mark James Essex witnessed a terrible crime. It is not something that could be brought in the court of law (at least in the 1970s) but it is something so offensive that an assault is a welcome alternative rather than the humiliation of a fellow human being from another. To be treated like an unclean animal is far worse than being hit in the nose with a straight punch. Moreover, the only excuse for such evil deed is the color of their skin. They have the same design, structure, and ability to feel and understand. The only difference is the way nature chose to color their skin and for M. J. Essex this is purely unacceptable. Fanning the Flames   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   There is a context to everything. M. J. Essex did not just turned into a monster overnight. His heart and mind received a continuous feeding of hate and discrimination although it was given to him passively. In the book Peter Hernon discovered that M. J. Essex’ father urged him to go to the Navy hoping that there is less prejudice there. His father served in the Army in World War II and he recounted that, â€Å"†¦they would send us down to Mississippi to train with wooden sticks† and recalled bitterly, â€Å"Now why would they send a black man from Kansas or anywhere in the Midwest to Mississippi without any way to protect himself† (p. 26).   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   A Reverend named W. A. Chambers told a similar story to the Essex family. He narrated a tale filled with the confusion and sadness accompanying discrimination and he said, â€Å"Negroes were forced to lock their weapons up at night while the whites were allowed to keep theirs in the barracks† (p. 26).   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   One could just imagine what was happening to the mind of the young M. J. Essex whose great hopes of a great America was crushed when he encountered the same sick thing that his parents had encountered three decades ago. These stories no doubt added fuel to the smoldering flame of hate and anger.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   What is needed now is an outlet to spew it out or it would surely ruin him inside. There is a great need to express the pent-up emotions and nature dictates that when pressure is building up then an explosion is imminent unless something happens in a way of releasing that pressure. Many like minded men had found solace, inspiration, and the letting go of dangerous build-up in the heart and mind by joining non-violent protests. The Civil Rights Movement under Martin Luther King, Jr. patterned perhaps from another model of non-violent movement such as that of Mahatma Gandhi who successfully overthrew an oppressive government without firing a single shot.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   On the other hand there are other groups who could not wait with older men in the hope of finding equality in their lifetime. Besides, both Martin Luther King, Jr. and Mahatma Gandhi died from bullet wounds. Is it not wise to give their enemies a dose of their own medicine? Fire against fire seems to be their motto and they were intent to make their presence known. J. Essex was caught up in the spirit of the times. In the dark times of his struggling with discrimination he came across literature concerning the Black Panther Party, a group who does not believe in the saying that the meek will inherit the earth. They would rather believe the opposite, and that is the violent will take what they deserve by force.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   For a young man with a military heritage – even if it was not an impressive one, his dad went to served in WWII – and his limited experience with the U.S. Armed Forces the proposition by the Black Panthers to take up arms is so much enticing for an angry young man longing for adventure and a chance to right what is wrong. Trigger   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   The context was established in the last few pages. The anger and restlessness did not come out from a vacuum. There is a history involved here that was traced to the bitter experience of M.J. Essex’ Dad in the U.S. Army.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   Now, the spark that ignited the powder keg of emotions came from two related sources. The first one occurred just after boot camp when he was humiliated in an enlisted men’s club, â€Å"A white boy showed him what to do, how they had to get ice in another room next to the bar. The white went in and got the ice without asking permission† (p.26). The second one is the fight with a man named Robert X. This guy, for no apparent reason could not go along with black people. His insecurity ran so deep that in the opening chapter of the book he was described to hate even the why black people walk. He is offended that the Negro race seemed to be happy and contented. Maybe he wanted them always suffering and cowed like slaves in plantations long gone.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   The third source is from the systematic way the Navy seemed to show its prejudice against him. An example is how his (M. J. Essex’ car) was being searched. It was deliberate and took sometimes half an hour to fully inspect his ride, something that would piss off any person irregardless of race and gender.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   All in all, â€Å"†¦what really burned Essex up was the riding he got from petty officers and other officers. They would write him up for the smallest infraction†¦Ã¢â‚¬  (p. 26). The last straw that broke the camel’s back was the terrible experience in the court-martial for he was dishonorably discharged from the Navy. At seven forty-five on the morning of October 19, 1970, M. J. Essex went AWOL. He was transformed overnight from a fun loving a guy who has nary a care in the world to someone constantly brooding, â€Å"†¦to think about what a black man has to do to survive† (p. 42). Conclusion   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   The Negro race has suffered many injustices from the time that they were captured and sold as slaves many centuries ago. It was such a perplexing tale of man dominating not the beasts of the earth and all the things that contain in it but fellow humans. What is more perplexing though is the slow process of emancipation, from removing them from the fields and into a real liberation where they will be considered as equals among men.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   The age of Reason has come and the Industrial revolution has ushered in a new way of understanding the world and social classes. Freedom was exploding like a beautiful rainbow in the minds and hearts of people around the world. After World War II that idea of independence and the importance of a single person could never be denied. Everyone enjoyed this privilege, all except the Negro race that had to suffer discrimination in the land of the free, in one of the most advance industrialized nation in the world, in the home of the brave the United States of America. There were only a few who went to fight for their rights. The spirit of the Negro was suppressed so it is understandable why they could not easily voice out their views. The white people who were not blind to such wickedness, they are the ones who should fight in their behalf yet many perpetuated the myth that the white race is superior over the blacks. The marc to freedom was a slow process, a procedure that sometimes get to be expedited by men of will and character. These few good men would cross the line and join their Negro brothers although society forbade him to do so. They were indefatigable in their fight to achieve racial equality in American society.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   But some black folks could not wait for their great white savior. They cannot even hold out for long with the likes of fellow blacks like Martin Luther King, Jr. A few would like to speed up the Civil Rights Movement a little bit and put it in the fast track. Into these ranks of violent persuaders one can find the names Huey Newton and Bobby Seale and their infamous Black Panther Party established in 1967. Their methods may be crude and their language may be vulgar, but it is enough to create a spark in the mind of a young black man whose back was pushed against the wall and every fiber of his being demanding for justice. Sometimes these feelings have to find an outlet or else it would be unbearable to live.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   Many in the Civil Rights Movement were fortunate to get in touch with someone like a Martin Luther King, Jr. who proposed a serious expression of their discontent. Through rallies and demonstrations they were able to voice out the pain that is inside them and it was a good form of release. But others chose another path, more deadly more sinister – it is to kill innocent people.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   Another clue as to why Mark James Essex would go down the road to perdition can be seen from the remarks of her mother that was picked up by the author, â€Å"Still, keenly aware of how white society dealt with rebellious blacks and afraid her son might be branded a misfit and possibly wind up in jail, she urged moderation†¦Ã¢â‚¬  (p. 44) This clearly shows that black people have a very negative view of white dominated society. By her mother’s statements it was clear that he can find no way out of the dark tunnel he is in. On both sides of the exit are white people waiting to pounce on him. There is no way out except with guns blazing and dying with a glorious death just like what the Black Panthers are advocating.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   It must be made clear that part of the context of the story of the sniper from New Orleans is the fact that he needed the ideological persuasion of the Black Panthers in order to move from anger, to extreme hatred of whites and then finally to kill in cold blood. Mark James Essex had the misfortune of joining the Black Panthers in a time when they too were desperate and are too eager to end their campaign in a spectacular display of bravado and recklessness. Sound of Thunder   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   The first casualty was Cadet Alfred Harrell, 19 years old, newly married and do not have any kind of relationship with Mark James Essex. The second casualty was Edwin Hosli, 27 years old and married. He too does not know Mark James Essex. These two facts are very significant because it outlines the problem of racial discrimination showing another disturbing facet on how man erroneously sees race and inequality. Many have fought this wrong thinking head on with bravery and wisdom. Men have died as martyrs who offered their blood as payment to stop further violence and prejudice towards blacks. Others have the same goal but with a different method of accomplishing their objectives.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   By killing Harrell, Hosli and the other victims of Mark James Essex shooting spree, the sniper has clearly shown which side he belongs. 1 Introduction Have you ever watched a group debate an ethical decision given a particular case study with several different variations to the story? It is fascinating to watch. Some of the individuals feel so strongly about being â€Å"right† they will argue until they get their point across. Others waffle and try to look at the situation from a variety of perspectives. Given a particular Case Study based on terms of confidentiality, this paper compares the basis of morality under two alternative ethical systems — Utilitarianism and Kantianism. We will explore the theory behind each ethical system, describe the facts of the Case, and interpret a course of ethical action using both ethical systems, and the significance of this dilemma. I chose to examine the Utilitarianism and Kantianism ethical systems because at times they seem diabolically opposed based on the theoretical reasoning behind choosing a particular action. Yet, in many cases the chosen action is the same. For this particular case on confidentiality, a personal relationship attempts to complicate how to determine the morally correct action. I explore this correlation by comparing Utilitarianism and Kantianism. Utilitarianism uses a relatively straightforward cost-benefit analysis where the calculation is â€Å"indifferent to persons and relationships (Dombrowski 2000:248). † Consequently, when using a Utilitarian system to examine what ethical action is appropriate everyone is â€Å"on equal footing (Dombrowski 2000:248). † This is somewhat of a simplistic view of how individuals make decisions; however, it is a simple view that allows you to make a somewhat unbiased decision. A decision not based on â€Å"rank, status, wealth, race, gender, or personal relationship (Dombrowski 2 2000:248). â€Å"Similar to Utilitarianism, Kantianism would also negate the significance of any personal relationships. The Kantian would do unto others, as they would consent to treating you. The one universal way to act should carry from person to person regardless of your personal relationship to that person. Let us explore the similarities and differences between these two ethical theories. Next, we will take a close look at the facts of one particular Case Study where personal relationships do come into play. Then, we will compare how a Utilitarian and a Kantian might act and why. What motivates the decision-makers under each moral system? 2 Comparing Theory 2. 1 Theory: Utilitarianism 2. 1. 1 Pleasure versus Pain: Utilitarianism is a somewhat general term for a variety of perspectives that all generally fall under the guise of this theoretical stance. In any case, I will attempt to summarize the major theoretical viewpoints of this ethical system. For the most part, Utilitarianism recognizes two absolutes in the world: pain and pleasure. Moral law follows the Principle of Utility, in other words, what motivates human beings. They found that Good has priority over the Right (Justice) (Griffin 2005, personal communication) and they make ethical decisions by determining â€Å"the greatest useful goodness for the greatest number of people (Dombrowski 2000:54). † Good equals happiness (pleasure) and alternatively bad equals pain or displeasure and has no value. Utilitarianism determines the right or correct action based on a formula that shows which action results in maximized good (happiness/pleasure). Maximized good takes into account all those individuals affected by the actions under consideration. 2. 1. 2 Cost-Benefit Analysis: Utilitarianism simplifies moral law to a quantitative calculation that determines ethical choice: Total Pleasure – Total Pain = Total Utility (Griffin 2005: personal communication). Utilitarianism uses a cost-benefit analysis to decide whether we tell or do not tell. We determine what is ethically 3 correct through an objective and quantitative measure of utilitarian goodness. â€Å"measure it for the appropriate number of people, compare it to measures of ill effects for the remaining people, plug it all into an algorithm, and calculate the solution (Dombrowski 2000). † Utilitarianism, born out of the technological and scientific revolution, uses a scientific approach to ethics. Theoretically, Utilitarianism does not take into account whose happiness is at stake and the action with the highest total utility is the correct action. 2. 2 Theory: Kantianism 2. 2. 1 Sense of Duty: A sense of duty is the guiding principle to Kantian theory. Ethics does not come from a higher authority nor does it rely on the individual to weigh the competing interests of the participants in an ethical dilemma. Unlike Utilitarianism, Kant’s ethical system represents a universal categorical imperative rule of ethics. The Categorical imperative is an expression of the moral law. The imperative is the correct, right, or good action taken in a particular situation. A categorical imperative â€Å"denotes an absolute, unconditional requirement that allows no exceptions, and is both required and justified as an end in itself, not as a means to some other end; the opposite of a hypothetical imperative (www. wikipedia. org). † In Kant’s Groundwork of the Metaphysic of Morals, he outlines the Categorical Imperative in three different ways (www. wikipedia. org): 2. 2. 1. 1 Universal Law formulation: â€Å"Act only according to that maxim by which you can at the same time will that it should become a universal law. † 2. 2. 1. 2 Humanity or End in Itself formulation: â€Å"Act in such a way that you always treat humanity, whether in your own person or in the person of any other, never simply as a means, but always at the same time as an end. † 2. 2. 1. 3 Kingdom of Ends formulation: â€Å"All maxims as proceeding from 4 our own [hypothetical] making of law ought to harmonize with a possible kingdom of ends. † 2. 2. 2 Reason versus Happiness: Kantianism recognizes Reason, not happiness or pleasure, is the foundation of moral law. Reason is the faculty of humans, which enables us to choose the principle, or rule on which we act (Griffin 2005, personal communication). The categorical imperative is an underlying moral system based on Reason, the integral link independent of a particular context — it is universal. To understand the basis of morality (the existence of a moral law) you must look for it in the capacity for reason and not in the capacity for pleasure and pain. The very foundation of Kantianism is that you must treat people the way they would consent to you treating them the same way. Your act is universal with no contradictions. Kant considers immorality as the product of individuals trying to create a different standard for themselves compared to the rest of humanity. Immorality ignores the categorical imperative. The Right comes before the Good (happiness); in other words, there are moral constraints on what one may do to promote happiness. One has a duty to obey the moral law, and the moral law is not determined by figuring out what promotes happiness (Griffin 2005, personal communication). You cannot reduce humans to meer means — treating someone is a way in which they would not consent. 3 Case Study Facts 3. 1 Case Study Overview: â€Å"You are employed as a technical communicator by Caduceus Company, a major provider of software systems for the health care industry. Currently, you are working on help-desk instructions for a new software system that operates from a database accumulated from all the records of all the hospitals, clinics, HMOs, laboratories, and physicians in your state. These records carry a good deal of highly personal information on patients and are, of course, private and confidential. The revelation of some of this information to the wrong people could be seriously damaging for those patients. Improper release of this information could, for example, limit their employability, damage their reputations, or restrict their access to health 5 insurance at affordable rates. Part of your job, in fact is to ensure that confidentiality is maintained by all who use the system while preventing access to those who might misuse it. Just yesterday, you learned of some shocking information. While observing the typical daily operation of the help-desk staff in resolving users’ questions, you recognized the name of one of the clients called up on a screen. It is the name of your cousin’s fiance, and the entry indicates that he has tested positive for HIV and has received counseling about HIV and AIDS from a local clinic. She would be highly endangered after marriage but also in their current relations without this knowledge. Do you reveal this information to your cousin but violate the privacy and confidentiality that you have sworn yourself to and are legally obliged to maintain? Or do you keep the information to yourself but jeopardize the health and life of your cousin by preserving the deception by her fiance (Dombrowsky 2000:238). † 3. 2 Choices or Ethical Action: As I understand the case, there are really only three different courses of action to choose from. 3. 2. 1 Do not say anything at all 3. 2. 2 Reveal the truth to your cousin 3. 1. 1. 2. 1 Talk to your cousin 3. 1. 1. 2. 2 Write an anonymous letter to your cousin 3. 2. 3 Confront the potential fiance 3. 1. 1. 3. 1 Talk to the fiance and explain why he needs to tell your cousin 3. 1. 1. 3. 2 Threaten fiance — if you do not tell my cousin I will tell 4 Comparing the Application between Ethical Systems 4. 1 To compare the moral significance of the above stated fact, I will look at the theory behind Utilitarianism and Kantianism to determine which action is the correct action. 4. 1. 1 Application: Utilitarianism 4. 1. 1. 1 According to Dombrowski (2000), he suggests Utilitarianism is the most reasonable ethical approach to take due to the simplistic nature of the principles of the Utilitarian moral law. However, he also recognizes how it is hard to apply measurable, objective costs to the loss of the technician’s job, professional reputation, â€Å"pain, suffering, violated trust, and a broken relationship (Dombrowski 2000:248). † In any case, I attempt to illustrate through the following Table (Table 1) what the Utilitarian application may look like. Fiance is upset by having to discuss with cousin Happiness for technical communicator and cousin, a little pain for fiance = high utility 4. 1. 1. 2 Examining the Table, you can see I have outlined three separate 6 choices, determined the total pleasure, total pain, and total utility. I was unable to determine an objective, absolute number to measure each factor, however, I did rank the total utility by low, medium, and high. As you can see, if the technical communicator chooses not to say anything at all, she would keep her job, but her cousin would most definitely contract HIV and her cousin could die from it or one of her kids could contract the disease. In any case, the cousins’ marriage is most definitely going to dissolve once she finds out that her husband was not open with her from the beginning. Consequently, I ranked the total utility to LOW UTILITY due to the extensive pain the cousin would ultimately endure. The second choice was for the technical communicator to reveal the truth to her cousin either directly or anonymously. The pleasure obtained from this decision would result in the technical communicator’s cousin not contracting HIV and living (as a result of this situation). However, the technical communicator would probably lose her job, the company could lose its credibility and that could effect the jobs of other company employees, and the technical communicator may not be able to find another job because she breached her trust with the client and her company. The total utility, therefore, results in a lot of pain for the technical communicator. Fortunately, the cousin would not contract HIV and increase her risk of dying. Due to the nature of the utility — death versus life, I ranked this decision at MEDIUM to HIHGH UTILITY because the cousin would experience a great deal of happiness that would far exceed the unequal but opposite pain of the technical communicator. The third choice, confront the potential fiance, would result in 7 pleasure for the technical communicator because she could keep her job. In addition, the cousin is able to protect herself from contracting HIV. In contrast, the fiance would be upset by having to discuss this difficult issue with his new wife. Due to these circumstances, I ranked this choice as having VERY HIGH UTILITY. The technical communicator is happy, keeps her job, and does not lose her cousin. Her cousin does not contract a life threatening disease. Yet, the fiance experiences discomfort with having to discuss this relatively important issue with his new wife. Consequently, a Utilitarianist would find this last choice to be the best and most ethically correct choice. Dombrowski (pg. 248) points out how difficult it is to reduce this case to a simple cost-benefit utility analysis for a number of reasons. Yet, the most poignant reason is the inability to neutralize the scenario and avoid the personal relationship the technician has with her cousin. Theoretically, the entire cost-benefit ratio should be the same no matter the personal relationship. However, I suspect your ethical action would tilt in a different direction should your motivations be driven by the patient’s partner. If you do not know the patient’s partner why would you risk your job, home life, and economic security for someone you do not even know. Is it really for the greater good? If so, why not find out everyone who has AIDS and post it on street corners? I am baffled by this strict compliance with the Utilitarian perspective. 4. 1. 2 Application: Kant 4. 1. 2. 1 Kant would argue that we â€Å"should act as we would expect others to act toward us and in way that should have universal applicability (pg. 247). † You must treat people the way they would consent to you treating them the same way. Given that this decision could 8 result in a life-threatening situation, Dombrowski argues that of course the cousin would want to know and would consent to treating them the same way. Dombrowski suggests that this is quite probably a universal ethical law. Yet, Dombrowski also recognizes that â€Å"most people probably would agree that the seriousness of the stakes so heavily tip the ethical scales against the side of blind compliance with the law that the ethical judgement to disclose should be binding on all people in such situations (pg.247). † In this interpretation, the seriousness and/or life threatening properties of the case motivate the Kantian. This interpretation suggests that the Kantian is obligated to the cousin and not to the patient — not because the cousin is a relative or has a special personal relationship to the technician. The technician is obligated to the moral universal law and would tell anyone should they find out. However, Kantian Moral law also says a promise should be kept. So then, the technician’s promise to her profession could take precedence over what appears to be the obvious categorical imperative. Kant might also agree with an ethical course of action where the technician approaches the potential fiance and makes it clear that if he does not tell, she will tell her cousin. In this variation, the categorical imperative recognizes that revealing this information to the cousin is in clear violation with the law. By approaching the potential fiance it also reduces the possible consequences because the outcome will ultimately result in your cousin finding out — but not through you. As a result, the Kantian does not violate the law but also does what is ethically correct. 9 5 Conclusion To summarize, Utilitarianism is an ethical system that proposes that â€Å"the greatest useful goodness for the greatest number of people† should be our guiding principle when making ethical decisions. In contrast, Kantianism suggests that the morally correct action is † an absolute, unconditional requirement that allows no exceptions, and is both required and justified as an end in itself, not as a means to some other end (www. wikipedia. org). † In the Case of Confidentiality, both Utilitarianism and Kantianism found that the best and most correct choice was to confront the fiance. In this scenario, â€Å"the presumed authority for methods & solutions is the profession meaning that personal ethics & religion do not have prima facie authority. † Yet, for the Kantian I think it is hard to figure out how to prioritize the relationships between competing duties (expression of law) — professional promise versus an individual ethics. I also wonder how your promise to your family to protect them and keep them safe plays into this account. However, the Utilitarianism cost-benefit analysis revealed how this ethical tradition takes into account all who are affected by the actions under consideration. As for the Kantian conclusion, the choice represented a universal expression of moral law. In both cases, the personal relationship did not and should not come into play as a significant fact. Although the men believe they are in control, it is really the women who are in the drivers seat. OCasey believes that the women in his play are stronger, more enduring and unselfish than the male characters. OCasey himself believed that women were secretly in charge. He had a very strong relationship with his mother, as his father died when he was only six years old. He was also the youngest surviving child out of his other thirteen siblings. As he was brought up by his widowed mother, he sees that women are dominant and men are weaker. In Juno, we find that the Boyle family have come into a great deal of wealth. Almost immediately, Captain Jack Boyle spends most of it, hence, giving him the title of the Paycock. Johnny Boyle, his son, has a secret, which gradually unfolds as the story progresses. It turns out that he has been a government informer; you didnt think o that when you gave him away to the gang that sent him to his grave. This ultimately leads to Johnnys execution; where were you when me darlin son was riddled with bullets. Juno Boyle, Boyles wife, in the centre of everything, is feeling the burdens of life on her shoulders as she tries to keep her family together. Mary Boyle, Jack and Junos daughter, has found a new boyfriend. He is Charlie Bentham, and is very rich. We are later told that he has left Mary as she is now pregnant. We then learn that there was never any money for the Boyles; Theres no money comin to us at all the Wills a washout! Fed up, Juno, with a drunkard husband and a dead son, finally leaves Boyle, with Mary at her side. This is where Juno says to Mary about her baby; Itll have whats far betther itll have two mothers. This is good for the child as Juno is responsible and will be able to use her own experience to her advantage. I expect that Boyle will be left on his own, possibly with his best friend, Joxer Daily, at his side. Boyle has done nothing to help or support his family in any situation. Boyle is the head of the house, but it is Juno who seems to do all the work since Boyle would rather spend his time sipping lager and telling tales. Juno is very responsible and very reliable, while Boyle is completely undependable and irresponsible. Juno will protect her family with her life, but Boyle is plain lazy; If it werent for the terrible pains in me legs is always his excuse for not finding a job to help support his family financially. Johnny and Mary are the children of Boyle and Juno. Johnny, who was injured fighting for Ireland, and Mary, who is on strike for the principle of it, are both still trying to grow up. Mary, the elder of the two siblings, is stubborn, saying that she will stick to her principles, and Johnny is trying to hide from his comrades. Johnny has recently become very sensitive and quiet. He is worried about the death of Robbie Tancred, an old childhood friend. Mary however, is still as outgoing as ever. She enjoys a social life, and does not seem at all phased about being on strike, and having an awkward family. Mary and Johnny are both similar in the way that they both stand up for what they believe in. Mary is on strike, and Johnny stands up for his beliefs for Ireland. He lost an arm, and received a permanent limp from fighting during the Easter Rising. Johnny feels disgusted that Mary is pregnant and yet he hasnt told anyone what he has done. She should be dhriven out o th house shes brought disgrace on! He is being hypocritical. Mrs. Madigan, Mrs. Tancred and Joxer are all friendly with the Boyle family. Joxer is Boyles butty and drinking companion. Mrs. Madigan and Mrs. Tancred are the Boyles neighbours. Mrs. Madigan and Joxer are both very friendly and wish to help out. Yet, Joxer is a lazy lay-about. Mrs. Tancred is in grief when we meet her, but speaks passionately about wanting no more deaths and killings. When Mrs. Madigan hears of the Boyles inheritance, she has nothing but good words for them. Though when she finds out that there is no money, she angrily confronts Boyle for money she lent him, and then takes his gramophone as payment. She seems very two faced; nice and friendly one minute, then the next she is biting off Boyles head. Jerry Devine was Marys old boyfriend. He is still in love with her, but she has found a new boyfriend. He is called Charlie Bentham, a rich school teacher, now turning to work in law. Jerry doesnt realize that Mary doesnt want to be with him. He says to her; Let me kiss your hand when she refuses to go back with him. He is completely obsessed with Mary. Charlie is in love with Mary too and helps the Boyles with the will. However when Mary becomes pregnant, Charlie runs away to England, afraid of commitment and the results of his actions. When Jerry comes to Mary again, he wants her to return with him, as he knows that Bentham has left. He doesnt know that Mary is pregnant, and when he finds out, he leaves in shock. On the surface, Jerry and Charlie both seem to love and care about Mary, but when the worst comes to the worst, they quickly leave her to fend for herself. The women in Juno and the Paycock have many positive characteristics. They have strength, determination and are all friendly and caring. They all have strength to get through hard times (eg. Juno supporting her family; Mrs. Tancred during her bereavement). Juno is determined to make Boyle find a job and no matter what the situation, they are always loving (eg. Mrs. Madigan always wanting to help out). Women are completely different from the men. The men are lazy (eg. Boyle not finding any jobs; Boyle and Joxer in the snug all of the time), money wasters (eg. Boyle spending the money on a gramophone), and contradictive (eg. Boyle says he doesnt like the church or Father Farrell, then saying that the country would be nothing without them). Womens qualities outweigh their faults. They are stronger and better than what their faults says about them. Their negative qualities say they are vain and stubborn, but this is nothing in comparison to their positive qualities of being strong, resilient, loving, caring and determined. During this period in history, women were made to feel that they were inferior to men. But, OCaseys play defies this. Juno stands her ground against the men, and when she has had enough of them, she leaves Boyle. Juno and Mary decide to make their own way in the world, and forget about Boyle. Itll have whats far betther itll have two mothers. I feel that the baby will be better off with two mothers, especially if they are Juno and Mary. They are both wise enough not to fall into traps set by men, and know how not to raise the child. Juno was a good mother to Johnny and Mary, and so will be a great help to Mary and her child. They would raise the baby to be everything that Boyle was not. Yes, the women are more superior to the men. They are smarter and wiser. Although the men feel that they are in power, the women are weaving their way through the woodwork.

The principle in this case is that a gift can only be enforced in equity if it satisfies one of the three modes set out in Milroy. The rationale in this case is that trusts should not be used to protect gifts from being defeated and follows the maxim that equity will not complete an imperfect gift.4 The common rule with regard to imperfect gifts is that equity cannot perfect an imperfect gift and this was demonstrated in Milroy v Lord, where the court held that equity will not assist a volunteer, and as such, equity will not perfect an imperfect gift.
